This agreement is between Dasynda Rosenbarger (Seller) of Sephora Bengals and the Buyer. Effective as of the date of signatures below and is binding upon all parties thereof. 1.) It is the buyer’s responsibility to have this cat/kitten examined by a veterinarian within 72 hours after adoption. This is your health guarantee period. If this cat/kitten is found to have an un-treatable or Severe life threatening disease that is felt to have been contracted at the seller’s home (documentation required by a licensed Veterinarian). Seller will replace this cat/kitten of equal value at the Seller’s first opportunity.

2.) This cat/kitten is guaranteed against all heredity defects up to the age of 3 year. Should a hereditary defect appear within the first 3 years, a Veterinarian must document it. The purchaser is obligated to immediately spay/neuter this individual. Upon supplying the seller with this documentation, seller will replace this cat/kitten with another of equal value at the seller’s first opportunity. Buyer understands that at no time for any reason will there be a monetary refund of any of the purchase price. Stress from a new environment can cause a healthy kitten to become ill. It is not unusual for a kitten to get an upper respiratory illness (like a common cold) or other stress related illness immediately after going to a new home. With good care, the Buyers Initials_______________ symptoms should subside rather quickly. Please contact us and your vet if you have any questions or need advice. This kitten cannot be guaranteed to be free from Feline Enteric Corona Virus (FeCV). It is estimated by a research physician at the University of Missouri Veterinary Teaching Hospital that 93.7% of all cats have contracted Feline Enteric corona Virus. FeCV can, on rare occasions, mutate and cause the fatal disease FIP. The effectiveness of the FIP vaccine is still controversial. Many researchers and veterinarians. believe it can create enough stress on the feline immune system to actually cause the disease, others believe that it is completely ineffective. Although research is continuing, at this time no one knows exactly why this disease occurs, or how to completely prevent it. Therefore, this entire health guarantee is null and void if the FIP vaccine is administered to this kitten. Once again, the breeder cannot guarantee that this kitten will never contract this disease. 3.) The cat/kitten cannot be returned after the guarantee period has expired. It is the responsibility of the buyer to provide immediate veterinary care to any cat/kitten showing signs of illness or distress. Failure to do so will render any guarantee null and void. Except the spay/neuter is in force no matter what the condition or problem. By signing this contract, the Buyer is also signing permission for their veterinarian to disclose any and all veterinary information pertaining to this said cat/kitten and any and all information on cats/kittens living with said cat/kitten. The Seller can ask which clinic and fax them a copy of this agreement to gain access, if need be. All veterinary fees are the sole responsibility of the Buyer.

 

4.) The seller guarantees fertility in this breeding animal with the exception of problems caused by pyometria which the breeder has no control over. If this cat has not produced viable offspring by the age of 2 years, after being serviced by at least two proven studs or queens whichever the case, the Seller agrees to replace the cat with one of equal value upon proof of spay/neuter by a licensed veterinary at Seller’s first opportunity. Seller does have the right to attempt to breed the cat on a Sephora Bengal cat before a replacement, for proof of infertility.

 

5.) This cat is not guaranteed against cosmetic faults, i.e. tail fault or locket. A cosmetic fault does not preclude the cat from being bred as it is not a health issue.

 

6.) No breeder male or female from SephoraBengals may be sold, placed, leased, loaned, traded, co-owned or given away to another breeder, or person unless written permission is received by the seller, Dasynda Rosenbarger with her signature. The said cat/kitten cannot leave the Buyers possession until they are spayed or neutered. *ALL BREEDING CATS SOLD MUST BE SPAYED/NEUTERED PRIOR TO LEAVING THE BUYERS HOME NO EXCEPTIONS!!!!!!

 

7.) If Buyer at any given time decides to sell this cat/kitten Sephora Bengals will be given first opportunity to buy the said cat/kitten back at ½ the purchase price, otherwise they must be spayed/neutered before placing with anyone else. (No Exceptions) SephoraBengals is not obligated to purchase said cat/kitten back. Buyers Initials_______________

If at anytime the seller cannot care for the cat/kitten SephoraBengals will take the kitten/cat back and try to find them a suitable home or the cat/kitten will stay with SephoraBengals.

 

8.) We do not recommend the use FIP vaccinations in Bengals. If found to have given this vaccination, the health guarantee is Null and Void.

 

9.) Kittens sold only as a pet. Purchaser shall spay or neuter Kitten between 3 months and 9 months of age. If not already done so by the breeder. Purchaser further warrants and agrees that Kitten shall not be used for breeding purposes. In the event Kitten is found to be used for breeding, Seller shall be entitled to receive an additional payment of $1,000.00, within 7 days of written demand being made upon the Purchaser Other Terms:

 

 

1.) A deposit fee is placed to hold a cat/kitten for a buyer. At this time I am holding the kitten for you and no one else can purchase the said cat/kitten, deposits must be received within 48 hours of selection of your choice kitten. If the deposit is not received within 48 hours you forfeit your choice and the kitten is offered to the next in line. All holding fees (deposits) are non-refundable. The goal of our Cattery is to place our cat/kittens in loving homes in a timely manner so they may bond with their new family. If a cat/kitten is held for a Buyer, a change of mind can quite often jeopardize the chance of that particular kitten to be placed in a home while they are still of a desirable age. When the sale of the cat/kitten is consummated, the deposit shall be applied toward the balance owing on the purchase price. The balance is due prior to any shipping or at the time of pick up. If paying upon pick up cash is the only form of payment accepted. All kittens must be picked up by 16 weeks of age unless the kitten has to be held longer due to weight or health issues. If the buyer does not pick said kitten up by 16 weeks the buyer agrees to pay 10$ per day past 16 weeks that the kitten is kept at the sellers house, if not the deposit on the kitten will be forfeited and the kitten put back up for sale.

 

2.) Under no circumstances will this cat/kitten or any offspring be sold, leased or given away to any pet store, research laboratory or similar facility. If Buyer or Seller commences any legal action as a result of this contract, Buyer agrees that the place of venue for such action shall be the state of Indiana in Clark County. Any legal fees incurred in upholding this contract will be paid by the Buyer. This contract is legally binding to all parties named within and applies to only the buyer and the seller named below and is not transferable to other parties. If the buyer sells cat/kitten to a 3rd party, the health contract is Null and Void, however the spay/neuter agreement is still applicable.

****Should any slander, causing any type of damage to the reputation of Sephorabengals and/or its owner, resulting from any disputes associated with this agreement and the aforementioned kitten, or should any part of this contract be violated, the Buyer agrees to pay fines of $10,000 in addition but not limited to, collection costs, attorney fees, court costs and all other expenses of enforcing the Buyers rights of the Seller under this agreement. Defamation, slander, accusation are inclusive of, but not limited to all social media platforms.

ADDITIONAL NOTES **Deposits can be made via Paypal, Venmo, Zelle, cash, or by check. **Cash is the only accepted form of payment at pickup, no exceptions! **At pick up please remember to bring a carrier! If you choose not to bring your own carrier one can be purchased from us at an additional $40.00. This arrangement must be made one week in advance.
